CONTEST RULES

“THE OCEAN VIP Ski Jet with WestJet.”

1. (a) The “Contest Period” starts at 6:00 am on February 8th 2010 and runs until 11:59 pm, February 28th, 2010, the “Contest Closing Date”.  To enter go to www.ocean985.com, and sign up to The OCEAN VIP PLATINUM CLUB for free via link and fully complete the sign up information, redeem 1000 Points and submit by the Contest Closing Date, for an entry into the Contest. If you are already a member of the OCEAN VIP PLATINUM CLUB log onto your account and redeem 1000 Points for a Contest entry in order to be eligible to win.  Individuals may enter as many times as they wish provided they redeem 1000 Points per entry.  . Members can also gather bonus codes by listening to The OCEAN Afternoon show from 3-6pm each day.  Each code will be worth 100 points and an entry to win The OCEAN VIP ski Jet with WestJet.  

 

NO PURCHASE NECESSARY. To enter this Contest without redeeming points or entering a Bonus Code during the contest period, please hand print your name, address, day and evening phone numbers, email address, age, Contest name for which you are entering for a chance to win, and a hand written 100 word letter explaining why you would like to win the OCEAN VIP Ski Jet Contest and mail it to 817 Fort Street, Victoria BC V8W 1H6. You will receive one (1) entry into the Contest during the entry period for which your request was postmarked and received, to be postmarked by the Contest Closing Date. Limit of one (1) mail-in request per postage stamped envelope per day

 

 

(b) Random draws by a Rogers Broadcasting Limited (“Rogers”) representative will be made on February 15th, 22nd, 28th from all eligible entries during the weekly contest period.   The selected entrants for the Grand Prizes will be contacted by phone or email at the phone number or email as indicated at the time of entry.  If the selected entrant cannot be contacted within five (5) business days following the draw, incorrectly answers the skill testing question, fails to return a signed release and acknowledgement form or declines the prize, another eligible entrant will be selected. 

 

c) Only one (1) chance to play per person during the entire Contest Period.

 

2. Participants are eligible to win one (1) of four (3) Grand Prizes.

 

Grand Prize # 1 (qualifying period is from February 8th-14th:

 

WestJet will provide return airfare for two (2) people on a scheduled WestJet flight from Victoria, British Columbia to Kelowna, British Columbia (“Prize Flights”).  The Prize Flights will depart from the Victoria International Airport to the Kelowna International Airport and return to Victoria International Airport on a regularly scheduled flight predetermined by WestJet (the “Prize Flight”).  The Prize Flight is subject to the terms and conditions listed below.    

 

Approximate retail value of the Prize Flight is $2000 CDN. 

 

Chateau Big White Commitment:

 

Chateau Big White will provide two (2) nights accommodation at the Chateau Big White in Kelowna, including lift tickets, lessons and rental equipment, airport transfers and tubing and skating tickets for 2 people (the “Hotel/ Ski Prize”).  The Hotel Prize value is $1200 CDN.

 

The Prize Flight and the Hotel/ Ski Prize are collectively referred to as the “Prize”.  WestJet and Hotel are collectively referred to as “Prize Suppliers”. 

 

Grand Prize # 2 (qualifying period is from February 15th-21st):

 

WestJet will provide return airfare for two (2) people on a scheduled WestJet flight from Victoria, British Columbia to Kelowna, British Columbia (“Prize Flights”).  The Prize Flights will depart from the Victoria International Airport to the Kelowna International Airport and return to Victoria International Airport on a regularly scheduled flight predetermined by WestJet (the “Prize Flight”).  The Prize Flight is subject to the terms and conditions listed below.

Firelight Lodge at Silver Star Commitment:

 

Firelight Lodge at Silver Star will provide two (2) nights accommodation at the Firelight Lodge at Silver Star including lift tickets, lessons and rental equipment, airport transfers and tubing and skating tickets for 2 people (the “Hotel/ Ski Prize”).  The Hotel Prize value is $1300 CDN.

 

The Prize Flight and the Hotel/ Ski Prize are collectively referred to as the “Prize”.  WestJet and Hotel are collectively referred to as “Prize Suppliers”. 

 

 

Grand Prize # 3 (qualifying period is from February 22nd-28th):

 

WestJet will provide return airfare for two (2) people on a scheduled WestJet flight from Victoria, British Columbia to Kelowna, British Columbia (“Prize Flights”).  The Prize Flights will depart from the Victoria International Airport to the Kelowna International Airport and return to Victoria International Airport on a regularly scheduled flight predetermined by WestJet (the “Prize Flight”).  The Prize Flight is subject to the terms and conditions listed below.

White Crystal Inn Commitment:

 

White Crystal Inn will provide two (2) nights accommodation at the White Crystal Inn in Kelowna, including lift tickets, lessons and rental equipment, airport transfers and tubing and skating tickets for 2 people (the “Hotel/ Ski Prize”).  The Hotel Prize value is $1200 CDN.

 

The Prize Flight and the Hotel/ Ski Prize are collectively referred to as the “Prize”.  WestJet and Hotel are collectively referred to as “Prize Suppliers”. 

 

 

Terms and Conditions of Prize:

 

In order to be awarded a Prize, the Winner must designate one (1) travel companion,  who must travel on Prize Flight with the Winner, at least  five (5) business days after being notified that he/she are Winners.  No changes to travel dates or passenger names are permitted once a booking has been confirmed for the Prize.  Winner and his/her guest must travel on the same itinerary for both the outbound and inbound portions of the Prize Flight.  Prize is valid until April 4th, 2010. Black outs dates for Prize is February 10-March 13, 2010. All prizes are based on availability at time of booking.

 

 

Fees, taxes and surcharges are not included and must be paid for by the winner with a valid credit card at the time of booking the Prize Flight.  Winners and designated travel companions are responsible for all expenses other than those mentioned above as included, including but not limited to ground transportation to and from gateway airports, meals, telephone, fax or cable charges, merchandise, souvenirs, travel insurance, travel documentation, hotel incidentals and all other personal expenses of any kind. The Prize Suppliers are not responsible for any delay, postponement, suspension, rescheduling or cancellation, for any reason, of any Prize and Winners will not be compensated in the event of such delay, cancellation or other event described herein.

 

Prize must be taken as offered and is neither transferable nor redeemable for cash, credit or alternative prizes, except in the Prize Suppliers’ sole discretion.  Prize cannot be sold and in the event that it is sold, the Prize will be void.  The Prize Suppliers reserve the right to substitute the Prize with a prize of equal or greater value.  No credit or reimbursement will be provided if Prize is not taken.  Prize cannot be combined with any other promotional offer or offers provided by Prize Suppliers.

 

Cancellations to the Prize are accepted up to 24 hours prior to departures. If cancelled, Prize will not be reinstated; Prize will be null and void.  Prize Flight is governed by laws, regulations, international conventions, WestJet’s tariffs and conditions of carriage.  Other restrictions may apply. 

 

Winners will be required to execute a legal agreement and release (“Release”) that confirms Winners: (i) eligibility for the Contest and compliance with the Contest Rules; (ii) acceptance of the Prize as offered; (iii) release of Prize Suppliers and their parent companies, subsidiaries, affiliates, employees, directors, officers, suppliers, agents, sponsors and administrators (collectively, the “Releasees”) from any and all liability for any loss, harm, damages, cost or expense arising out of participation in this Contest, participation in any Contest-related activity or the acceptance, use, or misuse of any Prize including without limitation, costs, injuries, losses related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising there from; and (iv) grant to Prize Suppliers the unrestricted right, in the its discretion, to produce, reproduce, publish, broadcast, communicate by telecommunication, exhibit, distribute, adapt and otherwise use or re-use the Winners’ name, photograph, likeness, voice and biography, in any and all media now known or hereafter devised, in connection with the Contest and the promotion and exploitation thereof. The Winners must also arrange for the signature and return of a Declaration and Release by each of their designated travel companions, who must also be a resident of British Columbia before being entitled to the prize. If the Winners’ guest is a minor, such person must have consent from their parent or legal guardian who must sign the Declaration and Release on their behalf and accompany them on the trip. The executed Release must be returned within two (2) business days of the verification as Winners or the selected Winners will be disqualified and the Prize forfeited. Winners must provide sponsor with full legal names of designated travel companions within three (3) business days after Release is signed and returned.

 

 

Due to the nature of the Grand Prize, no alternative dates are available other than those selected by Rogers. 

 

3. No purchase, expenditure or investment is necessary to enter the Contest.

 

4. All prizes must be accepted as awarded, may not be transferred, exchanged and/or converted to cash.   Rogers reserves the right to substitute a prize of at least equal or greater value in the event of the unavailability, for whatever reason, of the advertised prize.   It is the responsibility of the winner to claim the prize within thirty (30) days of being declared a winner.  

 

5. In order to be declared a winner, selected entrants must first correctly answer, unaided, a time limited, mathematical skill testing question, posed by telephone at a mutually convenient time.  Rogers judges' rulings are final and without appeal in all matters related to the Contest and the awarding of prizes.

 

6. Selected entrants will be required to return a signed release and acknowledgement form before being declared a winner. The travelling companions must also return a signed release and acknowledgement before being ticketed, once ticketed no changes are permitted.

 

7. By entering this Contest, each entrant consents to the use of his/her entry, name, and city of residence and/or photograph in any publicity carried out by Rogers and its advertising agencies, without further compensation.  

Winners consent to their photograph being taken by Rogers for such use, without further compensation.   All entries become the property of Rogers.

 

8. This Contest is open to the residents of the Victoria, British Columbia area and all 98.5 The OCEAN terrestrial listeners who are over the age of 19 as of the date of entry, except employees of Rogers, its parent and affiliate companies; its representatives and agents, the Contest suppliers and those with whom they are domiciled.  The Contest is subject to all applicable federal, provincial and municipal laws and regulations. 

 

9. No correspondence will be entered into except with the selected entrants.  

 

10. Chances of winning depend on the number of callers who successfully called in during Contest Period.  Rogers is unaware of how many entrants there may be.   The winners may come from any geographic area, so long as they otherwise qualify to enter the Contest.

 

11. All entries which are incomplete, illegible, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of the rules may be disqualified by Rogers.   Rogers takes no responsibility for lost, misdirected, late or destroyed entries, or for typographical or other production errors.

 

12. All entries become property of Rogers who assumes no responsibility for lost, stolen, delayed, damaged or misdirected entries or for failure of any telephone or radio equipment during the Contest Period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, broadcasting and communications hardware or software, failure of any email or traffic congestion on the internet or at any website, or any combination thereof including any injury or damage to an entrant’s or any other person’s property related to or resulting from playing or downloading or accessing any material in the Contest.   Rogers reserves the right, in its sole discretion, to cancel or suspend all or any portion of this Contest should a virus, bug or other cause beyond the reasonable control of Rogers corrupt the security or proper administration of the Contest. Rogers is not responsible for any errors or omissions in printing, advertising or broadcasting any aspect of the Contest. Any attempt to deliberately damage any system or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, Rogers reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

 

13. Rogers is collecting personal data about entrants for the sole purpose of administering this Contest.   No further informational or marketing communications will be received by the entrant unless the entrant provides Rogers with explicit permission to do so as indicated on the entry form.

14. This Contest will be run in accordance with these rules, subject to amendment by Rogers.   Entrants must comply with these rules, and will be deemed to have received and understood the rules if they participate in the Contest.

 

15. The terms of this Contest, as set out in these rules, are not subject to amendment or counter-offer, except as set out herein.
