98.5 The Ocean

CONTEST RULES
“CASH OR DASH ON THE OCEAN JET TO Napa Valley”
ROGERS BROADCASTING LIMITED
(“Rogers”)

1. (a) The “Contest Period” starts at 7:00 am on March 1st 2010 and runs until 5 pm, April 22nd 2010, the “Contest Closing Date”.  To enter, listen to 98.5 The Ocean (“Ocean”) during the Contest Period, and at approximately 8:20am, 11:20pm and 4:20pm, the sound of a jet will be played on air, and when the cue to call is announced, call 250-385-0985 and be caller number nine (9) in order to play Cash or Dash on the Ocean Jet to Napa Valley on air, the entrant will have the choice of being eligible to win the one hundred dollars ($100.00) Preliminary Prize, or forfeiting this Prize and obtaining an entry for a chance to win the Grand Prize.  All times are Pacific Times.

Callers will have five (5) seconds to respond once their call is answered.  If the telephone line is dead when answered by Ocean, or no audible response is heard, or no one responds after 5 seconds, Ocean will answer the next call in sequence and the next call in sequence will replace that call.  In the event a call is cut off before all personal data is collected, Ocean will make its best efforts to make contact with the cut off caller provided enough personal information was gathered in order to correctly identify the cut off caller.  In the event two or more calls come through on the same line, all such callers will be advised to hang up and try again and the next call in sequence and the next call in sequence will replace that call 
 
(b) Random draws by a Rogers Broadcasting Limited (“Rogers”) representative  will be made on March 5th, 2010, March 12th 2010, March 19th2010, March 26th 2010, April 9th 2010, April 16th 2010, April 23rd 2010, each a “Draw Date” from all from all callers who qualified by being the predetermined callers and who forfeited the Preliminary Prize as of the Contest Closing Date as of 11:59pm each Draw Date at approximately 6:00 am at the offices of 98.5 Ocean.  The selected entrants for the Grand Prizes will be contacted by phone or email at the phone number or email as indicated at the time of entry.  If the selected entrant cannot be contacted within five (5) business days following the draw, incorrectly answers the skill testing question, fails to return a signed release and acknowledgement form or declines the prize, another eligible entrant will be selected from all remaining predetermined callers.

(c) Only one (1) chance to play per person during the entire Contest Period.

2. Participants are eligible to win one (1) of seven (7) Grand Prizes, each having an approximate retail value of $1700.00, and consisting of a gift card from Flight Centre. 

3. No purchase, expenditure or investment is necessary to enter the Contest.

4. All prizes must be accepted as awarded, may not be transferred, exchanged and/or converted to cash.   Rogers reserves the right to substitute a prize of at least equal or greater value in the event of the unavailability, for whatever reason, of the advertised prize.   It is the responsibility of the winner to claim the prize within thirty (30) days of being declared a winner.  

5. In order to be declared a winner, selected entrants must first correctly answer, unaided, a time limited, mathematical skill testing question, posed by telephone at a mutually convenient time.  Rogers judges' rulings are final and without appeal in all matters related to the Contest and the awarding of prizes.

6. Selected entrants will be required to return a signed release and acknowledgement form before being declared a winner.
7. By entering this Contest, each entrant consents to the use of his/her entry, name, and city of residence and/or photograph in any publicity carried out by Rogers and its advertising agencies, without further compensation.  
Winners consent to their photograph being taken by Rogers for such use, without further compensation.   All entries become the property of Rogers.

8. This Contest is open to residents of residents of British Columbia, who are over the age of 19 as of the date of entry, except employees of Rogers, its parent and affiliate companies; its representatives and agents, the Contest suppliers and those with whom they are domiciled.   The Contest is subject to all applicable federal, provincial and municipal laws and regulations.

9. No correspondence will be entered into except with the selected entrants.  

10. Chances of winning depend on the number of callers who called in during Contest Period.  Rogers is unaware of how many entrants there may be.   The winners may come from any geographic area, so long as they otherwise qualify to enter the Contest.

11. All entries which are incomplete, illegible, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of the rules may be disqualified by Rogers.   Rogers takes no responsibility for lost, misdirected, late or destroyed entries, or for typographical or other production errors.

12. All entries become property of Rogers who assumes no responsibility for lost, stolen, delayed, damaged or misdirected entries or for failure of any telephone or radio equipment during the Contest Period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, broadcasting and communications hardware or software, failure of any email or traffic congestion on the internet or at any website, or any combination thereof including any injury or damage to an entrant’s or any other person’s property related to or resulting from playing or downloading or accessing any material in the Contest.   Rogers reserves the right, in its sole discretion, to cancel or suspend all or any portion of this Contest should a virus, bug or other cause beyond the reasonable control of Rogers corrupt the security or proper administration of the Contest. Rogers is not responsible for any errors or omissions in printing, advertising or broadcasting any aspect of the Contest. Any attempt to deliberately damage any system or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, Rogers reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

13. Rogers is collecting personal data about entrants for the sole purpose of administering this Contest.   No further informational or marketing communications will be received by the entrant unless the entrant provides Rogers with explicit permission to do so as indicated on the entry form.

14. This Contest will be run in accordance with these rules, subject to amendment by Rogers.   Entrants must comply with these rules, and will be deemed to have received and understood the rules if they participate in the Contest.

15. The terms of this Contest, as set out in these rules, are not subject to amendment or counter-offer, except as set out herein.
